1. About this Policy

This Job Board Policy governs the use of the AquaNetica job board, both by employers and recruiters who post roles and by candidates who apply.

In this Policy, “AquaNetica”, “we”, “us” and “our” mean AquaNetica Pty Ltd of Level 4, 114 William Street, Melbourne VIC 3000, Australia. “Employer” means any person or business posting a role, including a recruitment agency. “Candidate” means a member who views or responds to a posting.

This Policy forms part of our Terms of Service. Words defined in the Terms of Service have the same meaning here.

2. What the job board is

2.1 The job board is a venue connecting Employers and Candidates. We are not an employer, employment agency, recruiter or agent, we do not screen Candidates or Employers, and we are not a party to any employment, contracting or engagement arrangement.

2.2 Any offer, engagement, contract, payment, term or dispute is solely between the Employer and the Candidate.

2.3 We do not guarantee that any posting is genuine, that any role will be filled, or that any Candidate is suitable, qualified or entitled to work.

3. Posting a role

3.1 Postings must be for a genuine, currently available role. You must not post speculative advertisements to build a candidate database, roles that do not exist, or the same role repeatedly to gain prominence.

3.2 Each posting must clearly state the role, the employing or engaging entity, the location or whether it is remote, and whether it is employment, contract, casual or an internship.

3.3 Where you post as a recruitment agency, you must identify yourself as the agency. You may withhold the client’s identity, but you must not present the role as your own vacancy.

3.4 Postings must be accurate as to duties, requirements, qualifications, licences, remuneration and conditions. Do not describe as a requirement anything you would not in fact require.

3.5 Where a role requires a licence, certification, ticket or clearance, say so.

4. Legal compliance in postings

4.1 Postings must comply with all applicable employment, anti-discrimination, work health and safety, migration and privacy laws in the jurisdiction of the role.

4.2 Postings must not discriminate on the basis of a protected attribute, including race, colour, ethnicity, national origin, religion, sex, sexual orientation, gender identity, marital or parental status, pregnancy, age, disability or political opinion, except where a genuine occupational requirement or an exemption under the applicable law applies.

4.3 Where remuneration is stated, it must be accurate, and it must not be below any applicable minimum wage or award rate.

4.4 You must not post unpaid roles that are in substance employment. Genuine internships, student placements and volunteer positions must be described as such and must comply with the law that applies to them.

4.5 You are responsible for a Candidate’s right to work. We do not verify work rights, visa status or eligibility.

5. What you must not post

You must not use the job board to:

(a) advertise a business opportunity, franchise, investment, multi-level marketing scheme, or any arrangement requiring the Candidate to pay money, buy equipment or purchase training;

(b) charge Candidates a fee of any kind for applying, being considered, being placed, or for training or equipment associated with a role;

(c) collect personal information for a purpose other than filling the advertised role;

(d) advertise on behalf of a third party without their authority;

(e) promote a product, service or supplier rather than a role; or

(f) post anything that breaches our Community Guidelines or any law.

6. Applications and candidate information

6.1 When a Candidate applies, the information they submit, which may include their name, contact details, employment history, qualifications and any documents they attach, is passed to the Employer.

6.2 Employers must handle Candidate information in accordance with the privacy law that applies to them, use it only to assess the Candidate for the advertised role, keep it secure, and not disclose it to any other party or use it for marketing without the Candidate’s consent.

6.3 Employers must not add Candidates to marketing lists, sell or share Candidate information, or retain it longer than the applicable law permits.

6.4 Candidates should not include information they do not want the Employer to hold, and should not attach documents containing information belonging to a current or former employer.

7. Candidate responsibilities

7.1 Information you provide in an application must be accurate. Do not misrepresent your qualifications, licences, certifications or employment history.

7.2 You are responsible for satisfying yourself about an Employer and a role before you engage, including as to legitimacy, terms and conditions.

7.3 Be cautious of any request for payment, banking details or identity documents early in a process. Report it to us at info@aquanetica.com and to the relevant authority.

8. Fees

8.1 The job board is free for Candidates. We will never charge a Candidate to apply for a role.

8.2 Employer fees for posting, featuring or promoting a role are published on the platform and form part of this Policy. Billing, renewal, cancellation and refunds are governed by our Refund, Billing and Cancellation Policy.

The current employer fee schedule is published at aquanetica.com/pricing/ and forms part of this Policy.

8.3 A posting is published for the period stated at the time of purchase. We do not guarantee any number of views, applications or a successful placement, and fees are not contingent on an outcome.

9. Moderation

9.1 We may review, edit, categorise, decline, remove or expire a posting at our discretion, including where it breaches this Policy, appears inaccurate or fraudulent, or where we are required to by law.

9.2 We may remove a posting without refund where it breaches this Policy.

9.3 We do not pre-screen postings and are not responsible for their content.

10. Reporting

Report a suspicious, fraudulent, discriminatory or non-compliant posting to info@aquanetica.com. Report suspected fraud to the relevant authority as well as to us.

11. Concierge and recruitment services

Where we source workers on your behalf as a paid service, that engagement is governed by our Concierge and Procurement Services Terms rather than this Policy.

12. Liability

12.1 To the extent permitted by law, we are not liable for any loss arising from a posting, an application, an engagement, or any dealing between an Employer and a Candidate.

12.2 Employers indemnify us against any claim arising from their postings, their handling of Candidate information, or their conduct towards Candidates.

12.3 Our liability is limited as set out in clauses 13, 14 and 15 of our Terms of Service.

13. Changes

We may update this Policy from time to time. Changes take effect from the stated effective date.
