1. About this Policy

This Data Policy explains how we treat the data you provide to, or generate through, the AquaNetica platform. It sits alongside our Privacy Policy, which deals specifically with personal information and our obligations under the Privacy Act 1988 (Cth).

In this Policy, “AquaNetica”, “we”, “us” and “our” mean AquaNetica Pty Ltd of Level 4, 114 William Street, Melbourne VIC 3000, Australia. “You” and “your” mean you and, where you act for a business, that business.

This Policy forms part of our Terms of Service. Where this Policy and the Privacy Policy conflict in relation to personal information, the Privacy Policy prevails.

2. What we mean by Your Data

“Your Data” means data and information you provide to us or generate through the platform, including:

(a) account and profile information, including your business, role and sector;

(b) content you post in Community Spaces, listings, job posts, reviews and messages;

(c) operational information you enter, including system profiles, species, volumes, temperatures, production figures and calculator inputs;

(d) files you upload, including drawings, datasheets and documents;

(e) questions you ask AquaNetica IQ and the outputs it produces for you; and

(f) usage information about how you interact with the platform.

“Personal information” has the meaning given in the Privacy Act and is dealt with in our Privacy Policy.

3. Ownership

3.1 You own Your Data. Nothing in this Policy transfers ownership of Your Data to us.

3.2 We own the platform, our own content, our models of how the platform works, and any aggregated and de-identified datasets we create in accordance with clause 6.

4. What we use Your Data for

We use Your Data to:

(a) operate, maintain and secure the platform and provide the features you use;

(b) answer your questions through AquaNetica IQ and produce calculator results;

(c) personalise your experience, including calibrating AquaNetica IQ outputs to a project’s system profile;

(d) communicate with you about your account, the platform and features you use;

(e) diagnose faults, investigate misuse, and improve reliability and performance;

(f) improve the platform, including identifying which features are used and where members get stuck;

(g) meet our legal, regulatory, audit and record keeping obligations; and

(h) enforce our Terms of Service and other policies.

5. What we do not do with Your Data

5.1 We do not sell Your Data.

5.2 We do not use the content of your files, your AquaNetica IQ questions or your operational data to train artificial intelligence models, and our artificial intelligence providers process them under commercial terms that prohibit training on customer content.

5.3 We do not disclose your identifiable operational data, production figures or uploaded files to other members, to suppliers, or to any third party for their own marketing or commercial purposes.

5.4 We do not publish or share your identifiable operational data as a data product.

6. Aggregated and de-identified data

6.1 We may create aggregated and de-identified datasets and insights from platform activity, for example the proportion of members working with a particular system type, or general patterns in what the community is asking about.

6.2 Where we do, we will take reasonable steps to ensure that individuals and businesses cannot be re-identified, and that the aggregation is genuinely at a scale where re-identification is not reasonably possible.

6.3 We recognise that aquaculture is a small industry, and that a combination of species, region and scale can identify a single operator even without a name attached. We will not publish or share aggregated insights where the underlying sample is small enough that re-identification is a realistic risk.

6.4 We will not create aggregated data products from your operational data for sale or licensing to third parties without giving you notice and obtaining your separate consent.

7. Where Your Data is held and who processes it

7.1 The platform relies on third party service providers, including hosting, database, search, email, payment and artificial intelligence providers. Some are located outside Australia.

7.2 We choose providers that offer contractual protections appropriate to the data they handle, including terms prohibiting the use of customer content for model training where artificial intelligence services are involved.

7.3 Our Privacy Policy describes how we handle overseas disclosure of personal information and the safeguards that apply.

8. Files you upload to AquaNetica IQ

8.1 Files you upload to AquaNetica IQ are held on your own device and are transmitted to our artificial intelligence provider only to answer the question you have asked.

8.2 We do not store your uploaded files on our servers, do not add them to the AquaNetica IQ document library, and do not record their contents in our logs.

8.3 Detaching a file removes it from the conversation. Clearing your browser data removes files held on your device.

8.4 You are responsible for ensuring you have the right to upload a file, including where it belongs to your employer, a client or another third party.

9. Where your work is stored

9.1 Conversations, projects and saved calculations are currently stored in your browser rather than in an account-linked store. They are specific to the device and browser you use, may be cleared automatically after a period of inactivity, and will be lost if you clear your browser data.

9.2 This means we do not hold a copy of that work, and we cannot restore it for you. Keep your own copy of anything you need to retain.

9.3 If we introduce account-linked storage, we will update this Policy and give you notice before your work is stored differently.

10. Retention

10.1 We keep Your Data for as long as we need it for the purposes described in this Policy, and for as long as we are required to by law.

10.2 When you close your account, we will delete or de-identify Your Data within a reasonable period, except where we are required to keep it by law, where it is needed to resolve a dispute or enforce our agreements, or where it exists in backups, which are overwritten on our ordinary cycle.

10.3 Content you posted publicly in Community Spaces may remain visible where other members have quoted, copied or replied to it, as described in our Community Guidelines.

11. Security

11.1 We take reasonable steps to protect Your Data from misuse, interference, loss, and unauthorised access, modification or disclosure. These include access controls, encryption in transit, limiting the data we hold, and restricting what is recorded in our logs.

11.2 No online service is completely secure. We cannot guarantee the security of Your Data, and you are responsible for keeping your credentials secure and for the security of the device on which your work is stored.

11.3 If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme.

12. Your choices

12.1 You can access and update most of Your Data through your account.

12.2 You can delete content you have posted, subject to clause 10.3.

12.3 You can close your account at any time.

12.4 Requests to access or correct personal information are handled under our Privacy Policy.

13. Business members

Where you use the platform on behalf of a business, that business may have rights in Your Data under its own arrangements with you. You are responsible for ensuring you are authorised to provide Your Data to us and to grant the permissions in this Policy.

14. Changes

We may update this Policy from time to time. If we make material changes we will give you reasonable notice. Changes take effect from the stated effective date, and by continuing to use the platform after that date you accept the updated Policy.
