1. About these Terms
These AquaNetica IQ AI Assistant Terms (“AI Terms”) govern your use of AquaNetica IQ, our artificial intelligence knowledge assistant, including its chat interface, engineering calculators, file upload, projects and saved worksheets.
In these AI Terms, “AquaNetica”, “we”, “us” and “our” mean AquaNetica Pty Ltd of Level 4, 114 William Street, Melbourne VIC 3000, Australia. “You” and “your” mean you and, where you act for a business, that business and its personnel and authorised users. “AquaNetica IQ” means the assistant and all its features. “Output” means any answer, summary, calculation, recommendation or other content AquaNetica IQ produces.
These AI Terms form part of our Terms of Service. Where these AI Terms and the Terms of Service conflict, these AI Terms prevail for AquaNetica IQ. Words defined in the Terms of Service have the same meaning here.
By using AquaNetica IQ you agree to these AI Terms. If you do not agree, do not use it.
2. What AquaNetica IQ is
2.1 AquaNetica IQ is an information and research tool. It uses artificial intelligence to interpret your question, search a curated library of aquaculture and engineering documentation, and produce a written answer. It also provides engineering calculators for recirculating aquaculture system design.
2.2 AquaNetica IQ is not a professional adviser, does not make decisions for you, and does not supervise, monitor or manage your operation.
2.3 We may change, add to, limit, suspend or withdraw any feature of AquaNetica IQ, including the underlying models, the document library and the calculators, and we may do so without notice where necessary for security, legal or operational reasons.
3. Access and eligibility
3.1 AquaNetica IQ is available to AquaNetica members. Access depends on your membership tier.
3.2 Your account is personal to you. You must not share your credentials, allow another person to use your access, or use automated means to submit questions.
3.3 Usage limits, including monthly question allowances by tier, are published on our pricing page and form part of these AI Terms. We may vary limits on reasonable notice. We may apply rate limits, temporary restrictions or fair use controls to protect the service.
4. Acceptable use
You must not use AquaNetica IQ to:
(a) do anything unlawful, fraudulent, deceptive, harmful or misleading;
(b) obtain guidance on obtaining or using restricted veterinary chemicals, antimicrobials, therapeutants or regulated substances outside lawful channels;
(c) circumvent biosecurity requirements, quarantine conditions, import or export controls, environmental obligations or any permit condition;
(d) generate content that infringes any person’s intellectual property, privacy or confidentiality rights;
(e) upload content you do not have the right to upload;
(f) extract, scrape, replicate or systematically download the document library, the calculators, the Outputs or any part of the service;
(g) reverse engineer, probe or attempt to discover the underlying models, prompts, retrieval methods or source code;
(h) train, fine-tune or evaluate any artificial intelligence or machine learning model;
(i) build, assist or benchmark a competing product or service;
(j) resell, sublicense or provide access to AquaNetica IQ to any third party; or
(k) submit content that is malicious, or that is designed to manipulate, jailbreak or subvert the assistant’s instructions or safeguards.
We may suspend or terminate access for a breach of this clause, and may do so immediately where the breach is serious.
5. No professional advice
5.1 AquaNetica IQ does not provide veterinary, animal health, biosecurity, engineering, water chemistry, environmental, scientific, financial, investment, taxation or legal advice, and no Output should be treated as such.
5.2 An Output is not a substitute for advice from a suitably qualified professional who has assessed your specific site, stock, equipment, water and jurisdiction.
5.3 Calculator outputs are indicative estimates intended to support, not replace, engineering design by a qualified practitioner. They rely on the inputs you provide and on assumptions that may not suit your circumstances.
5.4 You must not use AquaNetica IQ in an emergency, or as the basis for any decision affecting animal health or welfare, human safety, biosecurity, environmental obligations or regulatory compliance, without obtaining qualified professional advice.
6. Accuracy, verification and your responsibility
6.1 AquaNetica IQ uses artificial intelligence. It can misread a document, combine sources incorrectly, omit relevant information, rely on material that is out of date, produce different answers to the same question, and state something confidently that is wrong.
6.2 We do not warrant that any Output is accurate, current, complete, suitable for your purpose or free from error.
6.3 You are responsible for independently verifying any Output before you rely on it, including by checking the underlying source material and consulting a qualified professional where the decision warrants it.
6.4 You are responsible for the inputs you provide. An Output based on incorrect, incomplete or misunderstood inputs will be wrong, and the calculators cannot detect that your figures do not describe your system.
6.5 Where a calculator is corrected or its method revised, results you have already saved may be marked as superseded. A superseded result should be recalculated before it is relied on.
6.6 You remain solely responsible for the decisions you make and the actions you take.
7. Compliance
Regulatory requirements differ by country, state, territory and species, and they change over time. Nothing produced by AquaNetica IQ confirms that any system, process, facility, practice or product meets any standard, permit condition, certification requirement or law. Compliance remains your responsibility.
8. The document library
8.1 AquaNetica IQ searches a curated library of aquaculture and engineering documentation. The library changes over time as material is added, updated or removed, and coverage varies by topic and species.
8.2 Documents in the library remain the property of their respective publishers and authors. Their inclusion does not imply any endorsement of AquaNetica by them.
8.3 Where a supplier, product or service appears in an Output, that reflects the contents of the library and any search we perform. It is not a recommendation, endorsement, or an assessment of quality, safety, compliance or suitability for your application. You must make your own enquiries.
8.4 We may receive a commission, referral fee or other benefit from suppliers and third parties, as described in our Terms of Service. Any such arrangement does not determine what AquaNetica IQ produces in response to your question.
8.5 If you believe material in the library infringes your rights, use the process in our Copyright and Content Takedown Policy.
9. Your content and your data
9.1 You retain ownership of the questions, files and other content you submit to AquaNetica IQ (“Your Inputs”).
9.2 You grant us a non-exclusive, worldwide, royalty-free licence to process Your Inputs to the extent necessary to operate AquaNetica IQ and produce Outputs for you, and to transmit them to our artificial intelligence providers for that purpose.
9.3 You represent that you have the right to submit Your Inputs, including where they contain drawings, specifications, data or documents belonging to your employer, a client or another third party, and that submitting them does not breach any confidentiality obligation or third party right.
9.4 Files you upload are held on your own device and are transmitted to our artificial intelligence provider only to answer the question you have asked. We do not store your uploaded files on our servers, do not add them to the document library, and do not record their contents in our logs. Detaching a file removes it from the conversation.
9.5 Your questions and uploaded content are processed by our artificial intelligence provider under commercial terms that prohibit their use to train artificial intelligence models.
9.6 Conversations, projects and saved calculations are currently stored in your browser rather than in an account-linked store. They are specific to the device and browser you use, may be cleared automatically after a period of inactivity, and will be lost if you clear your browser data. Keep your own copy of anything you need to retain.
9.7 We handle personal information in accordance with our Privacy Policy, and Your Data in accordance with our Data Policy.
10. Outputs
10.1 As between you and us, and to the extent permitted by law, you may use Outputs for your own internal business purposes.
10.2 Artificial intelligence systems can produce similar Outputs for different users asking similar questions. We do not represent that any Output is unique to you, and we make no representation that an Output does not resemble content produced for another user.
10.3 We do not warrant that an Output does not infringe any third party right. You are responsible for checking before you publish, distribute or commercialise an Output.
10.4 You must not present an Output as professional advice, as a certified design, or as work carried out or reviewed by a qualified professional, unless a qualified professional has in fact reviewed it.
10.5 If you share or publish an Output, you should identify it as having been produced with the assistance of an artificial intelligence tool.
11. Fees and allowances
11.1 Some AquaNetica IQ features are included with a free membership and some require a paid tier. The applicable allowances and fees are published on our pricing page and form part of these AI Terms.
11.2 Where you reach a usage limit, we may restrict further use until the limit resets or you upgrade. Unused allowance does not carry over between periods unless we state otherwise.
11.3 Billing, renewal, cancellation and refunds are governed by our Refund, Billing and Cancellation Policy and clause 8 of our Terms of Service.
12. Availability
AquaNetica IQ is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error free or secure, and it depends on third party services including artificial intelligence providers whose availability we do not control. We may perform maintenance, apply limits, or suspend the service where necessary.
13. Consumer law
Nothing in these AI Terms excludes, restricts or modifies any consumer guarantee, right, warranty or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law, where it cannot lawfully be excluded, restricted or modified. Where the service comes with a guarantee that cannot be excluded, and it is not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to comply with that guarantee is limited, at our option, to resupplying the service or paying the cost of having it resupplied.
14. Limitation of liability
14.1 Subject to clause 13, and to the maximum extent permitted by law, we are not liable to you for any loss, damage, cost or expense arising from your use of, or reliance on, AquaNetica IQ or any Output, including any loss of stock, production, profit, revenue, savings, goodwill, data or business opportunity, however arising.
14.2 Subject to clause 13, our total aggregate liability arising out of or in connection with AquaNetica IQ is limited as set out in clause 15.2 of our Terms of Service.
14.3 Our liability is reduced to the extent your acts, omissions or breach contributed to the loss, including where you did not verify an Output before relying on it.
15. Indemnity
To the extent permitted by law, you indemnify us and our personnel against any loss, liability, cost or claim (including reasonable legal costs) arising from Your Inputs, your use of any Output, your breach of these AI Terms, or your breach of any law or third party right.
16. Suspension and termination
We may suspend or terminate your access to AquaNetica IQ in accordance with clause 17 of our Terms of Service, and immediately where we reasonably consider that your use presents a security, legal or safety risk, or breaches clause 4.
17. Changes
We may update these AI Terms from time to time. If we make material changes we will give you reasonable notice. Changes take effect from the stated effective date, and by continuing to use AquaNetica IQ after that date you accept the updated AI Terms.
18. Governing law
These AI Terms are governed by the laws of Victoria, Australia, and clause 19 of our Terms of Service applies to any dispute.
